Hanwag Alpine Experience 2019

Application Conditions

Once a year, Hanwag GmbH, Wiesenfeldstr. 7, 85256 Vierkirchen (hereinafter referred to as “Hanwag”) organises the Hanwag Alpine Experience (hereinafter referred to as “HAE”), a guided mountain climb which takes more than four different routes to the Zugspitze. Together with Fenix Outdoor Ecom AB, a company affiliated with Hanwag and responsible for the Hanwag website, using this website Hanwag offers users the opportunity to apply to take part in the HAE (hereinafter referred to as “application”). In this way, Hanwag will allocate 4 participation places. The application and its implementation are based on the following conditions.

1. General

The HAE shall be carried out by Hanwag GmbH, Wiesenfeldstraße 7, 85256 Vierkirchen, Germany (“Hanwag”). The option to apply for the HAE can be linked via the online platform Facebook, but is in no way sponsored, supported or organised by Facebook. Any questions, comments and complaints relating to the application must be addressed directly to Hanwag and not to Facebook; this also applies to any claims in connection with the application. Anyone who meets the conditions of participation set out below and would like to get to know the Alps in a special way may apply for the HAE. 

The application period starts on 17.07.2019, 12:00 and ends on 22.08.2019, 18:00 (German time), (hereinafter referred to as the “application period”).

2. Participation

Any person who, at the time of registration, is over 18 years of age and is physically and mentally able to take part in the HAE, can apply for the HAE.

Participation is exclusively online via the website www.hanwag.de and is free of charge.

Applicants can enter their personal data in the application form. The application must in each case be terminated using the appropriate button so that the data can be transmitted correctly.

By sending the application for the HAE, all applicants without exception accept the terms and conditions of registration and the application of German law. Participation is independent of purchases and/or use of services.

3. Execution 

On 23.08.2019, four potential participants shall be selected by random from a jury composed of employees from Hanwag GmbH responsible for the organization of the HAE. Hanwag shall consider all applications submitted. The four participants have the option to take part in the HAE 2019. 

Insofar as an applicant is selected as a possible participant, it is a mandatory requirement for later participation in the HAE to agree to the terms and conditions of participation or to the exclusion of liability and the submission of a declaration of consent to photo/film recordings. 

Participation in the HAE includes bus transfer from the airport in Munich to Garmisch-Partenkirchen, accommodation in Garmisch-Partenkirchen, the supervision of state-certified mountain guides, catering, cableway tickets and a pair of Hanwag shoes in the individual’s size. The option to participate cannot be assigned to a third person.

4. Notification

The possible participants shall be notified by Hanwag via email within seven days after the draw. If a participant does not confirm their participation within 5 days after the notification email was sent, the participation shall be null and void. Applications who were not selected for the option to participate shall not be notified.

5. Exclusion from participation

Employees of Hanwag and of affiliated companies as well as their family members and relatives are excluded from participation. Persons who submit incorrect personal data are excluded from participation. 

6. Premature termination of the application phase

Hanwag is entitled to terminate the application phase at any time during the application period without prior announcement and without stating reasons. This applies in particular in cases in which it is necessary to end the Competition prematurely for organisational or legal reasons.

7. Data protection

b) Collection and processing of your personal data

We process the following data from you if you participate in the competition:

o Facebook/Instagram Account

We process the participants’ personal data to carry out the application to participate in the Hanwag Alpine Experience to determine inter alia whether you are eligible to participate as well as to determine and notify the possible participants via direct message. If you fail to provide us with the data mentioned, an application or contacting to provide notification of potential participation is not possible.

Your name as well as your date of birth solely serve to verify your eligibility and the appropriate form of address. By specifying the country, we check the existence of any entry requirements. Shoe size and T-shirt size are required to equip the participants. If you fail to provide us with the above-mentioned data, it is unfortunately not possible to make an application because it is not possible to verify.

c) Legal basis of the processing

The data processing is used exclusively for the purpose of implementing the application. The legal basis is Art. 6 (1)(b) of the EU General Data Protection Regulation (GDPR).

d) Recipients of the personal data

Your data will generally not be passed on to third parties, unless the disclosure is necessary for the execution of the application and there is an authorisation to transmit under data protection law.

All processors who are employed to perform services have been carefully selected, support Hanwag and are strictly bound by instructions and only obtain access to your data for the scope and the time period required to perform the services, or for the scope in which you have consented to the data processing and use.

e) Duration of storage

Once the application is completed, we will erase the applicant data we have stored relating to you. The data for the selected potential participants will be stored until the expiry of statutory retention and limitation periods. 

f) Your rights as data subject

You have the following rights against us regarding the personal data concerning you:

– right of access,
– right to correction or erasure,
– right to restriction of the processing,
– right to object to the processing,
– right to data portability.

You also have the right to complain to a data protection supervisory authority about the processing of your personal data by us.

g) Objection to or revocation of consent to processing of your data

If you have granted consent to the processing of your data, you can revoke this at any time. Such a revocation affects the admissibility of the processing of your personal data after you have expressed it to us.

Insofar as we support the processing of your personal data with a balance of interests, you can file a complaint against the processing. This is the case in particular if the processing is not required in order to fulfil a contract with you, which is set out by us in the following description of functions. When making such a complaint, we request that you set out the reasons why we should not have processed your personal data as we did. In case your complaint is justified, we shall review the circumstances and shall either suspend or adjust the data processing or show you our compelling grounds for protection, on the basis of which we continue the processing. 8. Limitation of liability

Hanwag is not liable for damages which could arise in the participation as a result of errors, delays or interruptions in transmission, in case of disruptions in technical equipment and the service, incorrect content, loss, unauthorized disclosure and/or erasure of data, or as a result of viruses or otherwise. Damages which are caused by Hanwag or its vicarious agents with intent, gross negligence or through the breach of cardinal duties, as well as damages resulting from injury to life, body or health, are not included in the above exclusion of liability. 

9. Final provisions

If there is reason to assume that an applicant or a third party is attempting to manipulate the course of the application through fraud, deception or deceptive and unsporting actions, Hanwag reserves the right to exclude the person/persons concerned from the application at its own discretion. Complaints about the operation of the application must be sent to Hanwag in written form within 14 days after the problem appeared. The selection of potential participants and the result are final. There is no legal recourse available.

The application is carried out exclusively in accordance with German law, regardless of the location/country in which an applicant applies.
